The information contained on THE PEOPLE FOUNDATION website is related to the services that are part of the People Foundation’s corporate purpose: fostering integration and improving the quality of life of people with disabilities and their families.

Acceptance of the Terms of Use

The use of the services offered by the website requires the acceptance of the rules of use that are in force at any given time at this electronic address. The user is hereby obliged to use the website as it is intended to be used in accordance with legislation currently in force, good faith and public order.

Intellectual Property

The ownership of the intellectual property rights of all the website contents is held by THE PEOPLE FOUNDATION and, where appropriate, by the authors, who have transferred the commercial exploitation rights to THE PEOPLE FOUNDATION. Under no circumstances should these rights be understood to have been transferred to the user; only that the right to private use of the information contained on the website is transferred to the user. Users are strictly prohibited from carrying out any type of commercial distribution of the data obtained from the website without obtaining prior express authorisation from THE PEOPLE FOUNDATION. Nevertheless, if, due to any legally established exception, data extracted from the website is disseminated, the copyright reservation and the source must be indicated, accompanying the disseminated data at all times. On the other hand, THE PEOPLE FOUNDATION holds the ownership rights of the intellectual property rights over the website, its graphic design and source code. The unauthorised reproduction, commercialisation, public communication, distribution or transformation of such works, except for personal and private use, constitutes an infringement of the holder’s intellectual property rights, sanctionable pursuant to legislation currently in force.

Liabilities

Any links provided on the website is exclusively to inform the user as to the existence of other sources of information, which may add to the contents of this website. THE PEOPLE FOUNDATION shall not be held responsible for the content, validity and accuracy of the information contained in such links. If areas for user participation are enabled (for example forums, chats, blogs, comments, etc.), THE PEOPLE FOUNDATION shall merely provide the space, with the result thereof simply being contributions or opinions made under the responsibility of the users. Therefore, THE PEOPLE FOUNDATION shall not be held liable for the opinions expressed in the different opinion pieces published on the website, and reserves the right to delete comments or suspend the use of web services should they violate the law,   morality, public order and, broadly speaking, when the website’s services are sought for advertising or commercial exploitation, to maintain incorrect ratings, or that infringe THE PEOPLE FOUNDATION’S legally recognised rights.

THE PEOPLE FOUNDATION shall not be responsible for any possible damages that may occur due to the use of the website contents, with the user being exclusively responsible in this regard. In this regard, THE PEOPLE FOUNDATION shall not be held liable with regard to possible damages that may arise from the use of an outdated or defective version of the browser, connection outages that occur while transferring data, computer viruses, breakdowns or disconnections in the operation of the digital system, blockages caused by issues or overloading of telephone lines, as well as damage caused by third parties as a result of unauthorised interference. The website suggestions section is merely informative in nature, and under no circumstances may any binding legal effect be derived from replies sent.

THE PEOPLE FOUNDATION reserves the right to interrupt or deny, at its own discretion, at any time and without having to give prior notice, access by any user to the contents, when any of the aforementioned circumstances arise. Without prejudice to the foregoing, the user hereby assumes that the administrative or judicial authorities shall be informed of any events that could constitute an unlawful activity, without the need to notify the user in advance.

Registration and access passwords

THE PEOPLE FOUNDATION may, where appropriate, provide its users, in a confidential manner, with a user name and password, which shall be unique, personal and non-transferable, and shall be necessary to access certain website services (free or paid). Where applicable, the user hereby undertakes to preserve the confidentiality of his/her password, and may request the modification thereof in the event of loss, knowledge by other people or any other circumstance that prevents or hinders their normal access thereto. The People Foundation reserves the right to cancel any user’s access password at its own discretion should unlawful use be suspected. The user assumes full responsibility and, therefore, all obligations arising from the use of services and products accessed with a password or from the use made thereof by third parties accessing them using the user’s password.

Privacy: Personal data collected through the different registration forms are subject to the terms set forth in our Privacy Policy.

Transparency: In the “OUR COMMITMENT TO THE LAW ON TRANSPARENCY” section, The People Foundation complies with the stipulations set forth in Law 19/2013, of 9 December, on transparency, access to public information and good governance, publishing the Foundation’s institutional, organisational and financial information in an accessible and open manner.

Applicable Law and Jurisdiction: This Legal Notice is governed by the laws of Spain.
